# Fabay Games Mobile Games Privacy Policy

## 1. Who We Are

Fabay Games is operated by Tugrul Hasan Furkan Abay ("Fabay Games", "we", "us", or "our"). For the purposes of applicable data protection laws, Fabay Games is the data controller for the information described in this Privacy Policy.

This Privacy Policy applies to mobile games published by Fabay Games that link to this policy (the "Games"). If a particular Game has a separate privacy notice, that notice will apply to that Game.

## 2. Our Approach to Children's Privacy

Some of our Games are designed for children. We aim to collect as little information as reasonably necessary to operate, protect, understand, and improve the Games.

Our Games do not require a player account. We do not ask children to provide their name, email address, telephone number, home address, precise location, photographs, voice recordings, contacts, or government identification numbers.

Parents and guardians should contact us at fabaygames@gmail.com if they have questions about a child's privacy or wish to exercise privacy rights on behalf of a child. Please do not include unnecessary personal information about a child in an email to us.

## 3. Information Processed When You Use the Games

### 3.1 Information stored locally on the device

The Games may store the following information locally on the device:

- game progress and rewards;

- selected language and character;

- tutorial completion status;

- premium purchase/unlock status; and

- the number of eligible game starts used to determine when an optional rewarded-ad choice may be shown.

This local information is used to remember settings and game progress. It is generally removed when the player resets the Game's data or uninstalls the Game, subject to the device and platform's backup settings.

### 3.2 Gameplay and analytics information

We use Google Analytics for Firebase to understand whether the Games work correctly and how game features are used. Firebase may automatically process an app-instance identifier, IP address, approximate location derived from the IP address, device type, operating system, app version, language, session information, and technical diagnostic information.

We also send limited gameplay events, such as:

- level started, completed, failed, or exited;

- completion time, hints used, and incorrect taps;

- whether a game question was answered correctly and the number of attempts;

- mini-game start and completion; and

- purchase screen opened and whether a purchase started, completed, or failed.

These events do not contain a player's name, email address, free-form text, exact age, precise location, or advertising identifier. We disable advertising-personalisation signals for analytics and disable Android Advertising ID collection in our Android configuration.

### 3.3 Advertising information

The free version of a Game may offer an optional rewarded advertisement that allows the player to continue playing. Players can decline the advertisement and return to the level-selection screen. Players who purchase the full version do not receive these rewarded advertisements.

We use Google AdMob and the Google Mobile Ads SDK to provide rewarded advertisements. AdMob may process technical and advertising-delivery information such as IP address, general location derived from IP address, device and app information, ad requests, ad impressions and interactions, privacy/consent signals, and information needed to prevent fraud and abuse.

For Games directed to children:

- ad requests are marked for child age treatment;

- personalised advertising and remarketing are disabled;

- the maximum ad-content rating is set to G;

- the Android Advertising ID permission is removed; and

- advertisements are requested through a Google Play Families self-certified version of the Google Mobile Ads SDK.

We do not sell children's personal information or use children's information for behavioural advertising.

### 3.4 Privacy choices

We use Google's User Messaging Platform (UMP) to determine whether a privacy message or privacy-options entry point is required in a user's region. UMP may process privacy-choice status, consent signals, app information, device information, and general region information needed to present the appropriate privacy message.

Where available, a parent or guardian can open Settings > Privacy Options in the Game to review or change the available privacy choices. Changing a privacy choice does not enable personalised advertising for a Game marked as child-directed.

### 3.5 Purchases

The Games may offer a one-time purchase to unlock all levels and remove rewarded advertisements. Purchases and restorations are processed by the relevant app store, such as Google Play. We do not receive or store the player's full payment-card details, billing address, or government identification number.

We receive limited transaction information from the app store, such as the product purchased, purchase status, transaction/receipt information, and information required to unlock or restore the purchase. The app store processes payment information under its own privacy policy and terms.

### 3.6 Information provided when contacting us

If a parent, guardian, or other user contacts us for support, we may receive the sender's email address and the contents of the message, together with any information the sender voluntarily provides. This information is used only to respond to the request, provide support, protect our rights, or comply with legal obligations.

## 4. Why We Process Information

We process the limited information described above to:

- provide, operate, and maintain the Games;

- save settings, progress, and purchase status;

- understand game performance and improve gameplay;

- detect errors, fraud, abuse, and security problems;

- provide optional, child-appropriate rewarded advertisements in the free version;

- process and restore purchases;

- respond to parent, guardian, or user support requests; and

- comply with applicable law and enforce our legal rights.

Depending on the user's location and the processing activity, our legal bases may include performance of a service requested by the user, compliance with legal obligations, our legitimate interests in operating and securing the Games where those interests do not override the user's rights, and consent or parental authorisation where required by law.

## 5. Service Providers and Sharing

We share information only as needed for the purposes described in this Privacy Policy with:

- Google LLC and its affiliates, for Google Analytics for Firebase, Google AdMob, the Google Mobile Ads SDK, UMP, Google Play services, and Google Play Billing;

- professional advisers and technical service providers where reasonably necessary to operate or protect the Games; and

- courts, regulators, law-enforcement bodies, or other authorised parties where disclosure is required by law or necessary to protect legal rights and safety.

We do not sell personal information. We do not share children's information for cross-context behavioural advertising or targeted advertising.

## 6. International Data Transfers

Google and other service providers may process information on servers located outside the player's country, including outside Türkiye, the European Economic Area, Switzerland, or the United Kingdom. Where required, we rely on a legally recognised transfer mechanism and appropriate safeguards under applicable law.

For transfers subject to Turkish Law No. 6698, we will use a transfer method permitted under Article 9 and applicable secondary legislation. For transfers subject to the GDPR or UK GDPR, service providers may rely on adequacy decisions, standard contractual clauses, or another legally recognised safeguard.

## 7. Data Retention

We retain information only for as long as reasonably necessary for the purpose for which it was processed:

- local game data remains on the device until it is reset, removed, or the Game is uninstalled, subject to platform backup settings;

- user-level and event-level Google Analytics data is retained for up to 2 months and is then deleted or aggregated in accordance with Google's retention controls; standard aggregated reports may remain available without identifying an individual player;

- advertising and privacy-choice information is retained by Google according to its applicable settings, policies, and legal obligations;

- purchase records may be retained by the app store and by us for as long as needed to provide purchase restoration, prevent fraud, comply with tax/accounting requirements, and establish or defend legal claims; and

- support correspondence is retained only as long as needed to resolve the request and meet legal obligations.

We do not retain personal information indefinitely merely because it may be useful in the future.

## 8. Security

We use reasonable technical and organisational measures designed to protect the information processed through the Games. However, no internet transmission, mobile device, or storage system can be guaranteed to be completely secure.

## 9. Rights and Choices

Depending on where the user lives, the user or their parent/guardian may have the right to:

- ask whether we process personal information and request access to it;

- request correction, deletion, destruction, or anonymisation;

- object to or request restriction of certain processing;

- withdraw consent where processing is based on consent;

- request information about recipients and international transfers;

- request data portability where applicable;

- object to a decision based solely on automated processing where applicable;

- lodge a complaint with a competent data-protection authority; and

- claim compensation where provided by applicable law.

Rights under Article 11 of Turkish Law No. 6698 may be exercised by contacting fabaygames@gmail.com. We will respond within the period required by applicable law and may request information reasonably necessary to verify the request and protect the player.

To make a request, use the email subject "Privacy Request – Fabay Games" and provide the name of the Game and the device platform. If the request concerns a purchase, a parent may also provide the app-store transaction identifier. Do not send a child's name, photograph, precise location, government identifier, or other unnecessary information.

A parent or guardian may also contact us to review or request deletion of personal information associated with their child. Deleting the Game or resetting its data can remove locally stored game information; platform backups may need to be managed separately through the device or app-store account.

## 10. United States State Privacy Rights

Residents of certain United States states may have additional rights, including rights to know, correct, delete, or obtain a copy of personal information and to opt out of certain sales, sharing, or targeted advertising. We do not sell personal information or use children's information for targeted advertising. Available regional choices can be accessed through Settings > Privacy Options when UMP indicates that an entry point is required.

## 11. Changes to This Privacy Policy

We may update this Privacy Policy when the Games, service providers, or legal requirements change. We will update the "Last updated" date and, where required, provide additional notice in the Game or store listing.
